Shared Parenting Council of Australia


The Shared Parenting Council of Australia was incorporated in September 2002 as a representative body for a range of Parent, Children, Church and Family Law Reform organisations who share the common purpose of prescribing in law, every child's fundamental human right to an equal opportunity and relationship with both their Mother and Father following parental separation or divorce.
The Shared Parenting Council has maintained a commitment to the primary principal that each parent shall facilitate and encourage a close relationship with children ensuring that children have the benefit of both of their parents having a meaningful involvement in their lives and is working to deliver real shared parenting time outcomes for children The Shared Parenting Council believes in the fundemental principal of a presumption of equal time notwithstanding the safety of children is paramount and the ability of one or other of the parents to support equal or substaintially equal time arrangements

A child's right to a meaningful relationship with his or her father trumps a woman's right to pursue personal happiness after divorce, according to the latest ruling on the matter by a federal magistrate. However, the shared parenting law is the subject of a government review.

An Adelaide mother went to court to prevent her daughter from referring to her ex-husband's new wife as "Mum" or "Mummy" or "my other Mummy". The mother said the father was "attempting to replace her as the child's mother by encouraging the child to call his new wife "Mum". The Family Court case sets a precedent for Australia's million-strong blended families, where arguments over who is to be called what are commonplace.

Remember the Mt Isa case. In MRR V GR in considering whether he should therefore make an order under s 65DAA(1) for the child to spend equal time with each of her parents, the Federal Magistrate addressed only the question whether it was in the childs best interests for her to spend equal time with each of her parents. He made no assessment of whether spending equal time with each parent was actually feasible. That is, he failed to make a finding about a statutory condition which was mandatory in determining whether an order for the child to spend equal time with her parents could be made. The The High Court allowed the wifes appeal and ordered that the orders of the Federal Magistrates Court be set aside. The matter was remitted to the Federal Magistrates Court to be reheard.
